Delhi High Court interim Order to GGSIPU to not to accept CLAT Score for LLB | BA LLB Admission

An interim order has been passed by Delhi High Court stating that Guru Govind Singh Indraprastha
University (IPU) can’t accept the CLAT score for admission to BALLB course in academic session 2019-20.

What is the matter ?


As per petitioner view point, designating a separate Test Agency is against the provisions of 2007 Act.

Who did give GGSIPU right to adopt CLAT ?


On February 11, 2019, the Directorate of Higher Education, Delhi Government had passed an order
which enabled GGSIPU to accept the national level tests for admission to certain courses like CLAT.

Who is petitioner and what are their grievances?


The Petitioner is an association of twelve (12) private Colleges which provide LL.B. degree and are
affiliated to GGSIPU.


The grievance of the Petitioner is against the stipulation that the GGSIPU could adopt the scores in CLAT which is conducted by a Consortium of National Law Universities, for admission to undergraduate Law courses offered by Colleges affiliated to it.

The petitioner argument says that Common Entrance Test (CET) is required to be conducted, as done in past. As per the order of Directorate of Higher Education, Delhi Government; there is no provision of adoption of the score of other agency for admission to courses provided in the college.

The Court Verdict?


The Court observed that prima facie, the Act does not allow University to take decision or designate the agency to process the admissions and the decision taken by GGSIPU to enroll students for their BALLB program through CLAT is contrary to the provision of the Act.
The plea of GGSIPU of inability to conduct CET, at this juncture, was also rejected.

The next hearing is scheduled to be May 23, 2019.
